GENERAL ASPECTS

1. These general conditions (the “Conditions”) shall apply when you, as a buyer (“You”), place an order through the website www.ourholyart.com and the pages related to it (the “Site”). The contract is entered into between the owner of Our Holy Art, identified with the tax identification RUC 10244958287, and You. On the Site you will find detailed information and other information about Our Holy Art. The conditions are only applicable to you, who are the buyer and who place orders through the Site.

2. In order to place an order on the Site, you must be 18 years of age. Our Holy Art does not accept any credit purchases made by persons under 18 years of age. Our Holy Art reserves the right to refuse or modify your order in specific cases (for example, if the information you have provided is incorrect and/or you are in default).

3. Our Holy Art expresses its reservations about the interruption of the sale and possible errors in the images or misprints on the Site, for example, errors in the product description or in the technical specifications, incorrect prices or adjustments thereto or incorrect information regarding whether a product is in stock. Our Holy Art has the right to correct any such errors and to modify or update the information as it deems appropriate. If an incorrect price has been indicated for a product for which you have placed an order, Our Holy Art will obviously inform you about it and will await your confirmation of the corrected price before proceeding with the order. All information contained in images appearing on the Site shall be interpreted as merely illustrative. It cannot be guaranteed that such illustrations correspond to the exact appearance of the product. Our Holy Art assumes no responsibility for the information contained on the Site originating from a third party.

4. The Site, as well as all content included therein, is the property of Our Holy Art or its licensors. The information is protected, among other things, by intellectual property and market laws. This means that trademarks, company names, product names, images, graphic, design and layout aspects, as well as information on products, services and other content may not be copied or used without the written permission of Our Holy Art.

CONTRACT AND ORDER PLACEMENT

1. In order to make a purchase through the Site, you must accept the Terms and Conditions. By accepting the Terms and Conditions, you agree to comply with them in their entirety, in addition to confirming that you have read the information on personal data and give your consent to the use of such data and cookies in accordance with the Privacy Policy, which can be consulted here.

2. The purchase contract is formalized at the moment that Our Holy Art has confirmed your order and you have received the order confirmation from Our Holy Art by e-mail. Our Holy Art asks you to keep this order confirmation for possible contact with Our Holy Art’s customer service. You may cancel your order up to the moment it has been confirmed by Our Holy Art. In case of cancellation of the order, Our Holy Artwill refund you all possible amounts that your credit or payment company or You have made in relation to the order.

CUSTOMER AND OTHER DATA

1. When you register your user account and/or place an order, we will ask you to provide certain personal data. You confirm that the data you provide are correct and complete and you assume responsibility for any data you have provided incorrectly. In the Privacy Policy you will find information on the processing of personal data by Our Holy Art.

2. You undertake that no other person will use your data to log in. You may not disclose your user name and password to any unauthorized person and you will ensure that both are stored in such a way that no unauthorized person can access this information. If you suspect that any unauthorized person has accessed your password, you must notify Our Holy Art immediately. You are responsible for all purchases made with your login data in case of failure to make such notification.

3. In the event that the Our Holy Art suspects that you are misusing your user account or login data, or otherwise violating the Terms, the Our Holy Art has the right to terminate your membership. Our Holy Art also has the right to provide you with new login information.

PRICES, FEES AND PAYMENT

1. At the time of payment through the Site, the prices indicated therein apply. Prices are indicated in U.S. dollars (USD) and include taxes.
Prices include standard shipping costs only for countries of the American continent. Shipping costs to countries outside the Americas are indicated separately.

2. You can pay in the ways indicated on the Site. You can read more about our payment methods on the Site here. Our Holy Art reserves the right not to always offer all forms of payment or another form of payment if the one you have chosen, for whatever reason, does not work at the time of purchase. Please note that possible limitations regarding payment methods are indicated on the Site.

DISCOUNTS AND OFFERS

Our Holy Art may, when it deems appropriate, offer promotions on the Site that may have more favorable conditions than those indicated in these Terms and Conditions, for example, in relation to payment or an extension of the right of withdrawal. These more favorable conditions will be in force for the entire period of validity of the promotion and for the specific products indicated by Our Holy Art in conjunction with the promotion. Our Holy Art reserves the right to cancel, when it deems appropriate, such promotions. When a promotion has been terminated or cancelled, these Terms and Conditions shall apply without change. Discounts on specific products on the Site are valid for a limited period of time and as long as they are in stock.

DELIVERY AND TRANSPORT

1. Products that are in stock are delivered within the period of days indicated on the Site. Unless otherwise agreed (e.g. in relation to the reservation of products not in stock), delivery at destination is made within 25 to 35 days (all international destinations) from the written confirmation of the order by Our Holy Art . 2. The estimated delivery time of the products is indicated in the order confirmation, at checkout and/or on the specific product page of the Site. If not otherwise agreed and a delivery takes more than 40 days and this is not your fault as a customer, you have the right to cancel the purchase.

3. You will normally receive the package at your home address or the address you indicate in the Checkout section of the Site. If you send to another address you must be completely sure that the address indicated is correct and you must indicate the full name of the recipient who will receive it at destination.

WARRANTY AND CLAIMS

1. Some of the products may be covered by warranty. On the Site and in these Conditions you can consult the information on the possible warranty period and the specific warranty conditions of the relevant product. The warranty of the products covers only original factory failures and, therefore, does not cover failures that occur when the function and appearance of the product is modified, or thereafter, such as a rebuild, upgrade or other configuration of the product. Your order confirmation is valid as proof of warranty.

2. The right to claim covers products that are defective in accordance with the consumer protection laws in force in the country of origin. Buyers who wish to point out defects in the product they have purchased should contact Our Holy Art customer service as soon as possible after detecting the defect through the contact details indicated on the Site. Complaints made within one months after detecting the defect shall always be considered as having been made within the relevant period. You have a 3-month right of complaint on products purchased on the Site.

3. When the product complained about has been returned and the complaint is approved, Our Holy Art will compensate you in accordance with the consumer protection laws in force. Our Holy Art will do its best to do this within 14 days after Our Holy Art has received the claim, but it may take longer, depending on the nature of the product. Our Holy Art reserves the right to deny a claim if the product is shown not to be defective in accordance with applicable consumer protection laws.

DISCLAIMER OF WARRANTIES AND LIMITATIONS

Our Holy Art assumes no responsibility for delays caused by circumstances over which Our Holy Art has no control such as, Covid-19 pandemic, general labor disputes, extreme weather conditions, war, fire, lightning strikes, terrorist attacks, changes in government regulations, technical problems, breakdowns in electrical, telephone or data connections or other communications, as well as breakdowns or delays in the services of subcontractors as a result of the circumstances stated herein. These circumstances shall constitute the basis for exemption from liability for damages and other consequences. Should any such situation arise, Our Holy Art will inform you at the beginning or end of the term of the situation in question. In case the circumstances have extended beyond two months, Our Holy Art and You are entitled to cancel the purchase with immediate effect.

MODIFICATIONS TO THE TERMS AND CONDITIONS

Our Holy Art reserves the right to make modifications to these Conditions whenever it deems appropriate. All modifications to these Conditions will be posted on the Site. The modifications will take effect from the time you have accepted the Conditions (in connection with a new purchase or when you visit the Site) or, alternatively, 30 days after Our Holy Art has informed you about them. Therefore, Our Holy Art recommends that you check the Site periodically, in order to be informed of possible changes to the Conditions.
